Maintenance Plan Terms & Conditions

These Maintenance Plan Terms & Conditions (“Terms”) govern enrollment in Empower Home Services’ preventative maintenance and monitoring plans (“Maintenance Plans”). By enrolling in a Maintenance Plan, you (“Customer”) agree to these Terms.

1. Maintenance Plan Services
Empower Home Services (“Empower,” “Company,” “we,” or “us”) provides preventative maintenance, inspection, and monitoring services for residential home systems, which may include HVAC, solar, battery storage, electrical, and related components, depending on the Maintenance Plan selected.

The scope, frequency, and benefits of services vary by plan.

Your selected Maintenance Plan defines exactly what services are included.

2. Preventative Maintenance Only
Maintenance Plans are limited strictly to preventative maintenance, inspections, monitoring, and related benefits.

No repairs, replacements, or improvements are included in any Maintenance Plan.

If repairs or additional services are needed, Empower will provide an estimate and services will only be performed under a separate written agreement.

3. Term & Automatic Renewal
Initial Term
Each Maintenance Plan begins with a twelve (12) month initial term starting on the enrollment date.

Automatic Renewal
After the initial term, the Maintenance Plan will automatically renew for successive twelve (12) month terms unless canceled in accordance with these Terms.

Maintenance Plans include recurring billing for continued services.

Any changes to pricing or material terms will be provided with at least 30 days’ written notice.

Continued participation after notice constitutes acceptance of the updated terms.

4. Billing & Payments
Maintenance Plan fees are billed monthly or annually, depending on the option selected at enrollment.

Fees are billed in advance to the payment method on file.

Certain Maintenance Plans may include a non-refundable activation fee.

If a payment fails, services may be suspended until payment is received.

A $10 late fee may apply to restart services after a missed payment.

5. Cancellation Policy
Cancellation After Initial Term
Customers may cancel their Maintenance Plan after the initial 12-month term by providing at least thirty (30) days’ notice prior to renewal.

Cancellation During Initial Term
If a Maintenance Plan is canceled during the initial term, an early termination fee equal to 50% of the remaining recurring charges for the current term will apply. This fee is intended to recover costs and benefits applied in anticipation of the full term and is not a penalty.

6. Customer Responsibilities
Customers agree to:

Provide safe and reasonable access to equipment and service areas.

Maintain accurate contact and billing information.

Notify Empower promptly of system issues, changes, or safety concerns.

7. Company Responsibilities
Empower will:

Perform services in a professional and workmanlike manner.

Maintain appropriate licenses, insurance, and certifications.

Empower Home Services is a licensed California contractor (CSLB #1057693).

8. No Guarantee
Maintenance Plans are designed to reduce the likelihood of system issues, but do not guarantee uninterrupted, failure-free, or optimal system performance.

Breakdowns or malfunctions may still occur.

Service intervals and scope may differ from manufacturer recommendations.

Empower is not responsible for outcomes related to such differences.

9. Limitation of Liability
To the fullest extent permitted by law:

Empower is not liable for indirect, incidental, special, or consequential damages.

Empower’s total liability is limited to the amount paid for Maintenance Plan services.

This limitation does not apply to gross negligence or willful misconduct.

10. Force Majeure
Empower is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, utility interruptions, or government actions.

11. Communications Consent
By enrolling, you authorize Empower and its partners to contact you regarding your account, services, or billing by phone, email, or text, including automated systems where permitted by law. You are not required to consent to marketing communications as a condition of service.

12. Dispute Resolution & Class Action Waiver
Disputes arising from Maintenance Plans may be resolved through binding arbitration if agreed to at enrollment. Claims must be brought on an individual basis, and class or representative actions are waived where permitted by law.

13. Governing Law
These Terms are governed by the laws of the State of California, with venue in Fresno County, California.

14. Right to Cancel (California Notice)
California residents may cancel within three (3) business days, or five (5) business days if age 65 or older, after enrollment, as required by law.

15. Entire Agreement
These Terms, together with your selected Maintenance Plan details, constitute the entire agreement between you and Empower Home Services.
